Georgia Private Time Frames


Step 1: Notice
  • Request the Notice of Commence from Owner prior to furnishing. Serve notice within 30 days of first furnishing or 30 days from receipt of the Notice of Commencement, whichever is later. Contractors and suppliers may file a notice with the clerk of Superior Court for additional benefits.

Step 2: Lien
  • Within 90 days after the completion of work or last furnishing of materials.
  • Serve a copy of the lien to the owner and prime contractor within 2 business days of filing the Claim of Lien.

Caution: See WAIVER section for important statute detail within 45 days of signing a Waiver/Release when payment has not been received.

New statute 1/1/21: Affidavits of Non-Payment filed within 90 days of execution when payment is not received.


Step 3: Forclosure
  • Within 365 Days from the date of filing the claim of lien or 60 days from the time of receiving notice to commence a lien action.
