North Carolina Private Time Frames


Step 1: Notice
  • If a Notice of Contract is filed by a Prime Contractor, the Subcontractor/Supplier must file a Notice of Subcontract to protect their interests. Serve as soon as possible to trap unpaid funds. See Speed Bumps.
  • For any project with a contract price greater than $30,000 (except a single-family home renovation where the home is the owner's residence):
    • Provide notice to the lien agent on the NC public database within 15 days of furnishing labor or materials.

Step 2: Lien
  • File and serve owner and prime contractor within 120 days of last furnishing.

Step 3: Foreclosure
  • Within 180 days of last furnishing.

Step 1: Notice
  • Serve Notice of Claim of Lien Upon Funds on the obligor (owner) as soon as possible to trap unpaid funds. See Speed Bumps.

Step 2: Suit
  • File within 1 year from date the lien was served.
