Rhode Island Private Time Frames


Step 1: Notice
  • Prime Contractor or others direct to owner or tenant of land: Notice prior to commencing work.
  • Suppliers: No requirement, NACM suggests serving notice 45 days from last furnishing to prompt payment.

Step 2: Lien
  • Serve the owner the Notice of Intention within 200 days from first furnishing. A late notice will be effective for furnishing in the 200 days prior to the mailing and thereafter.
  • File the Notice of Intention the  earlier of 200 days from first furnishing on unpaid amounts or of last furnishing labor or materials whichever is earlier.
    • NOI filing will only relate back 200 days from recording. File the Notice of Intention with 200 days of Last furnishing labor or materials.

Step 3: Foreclosure
  • File suit within 7 days after filing a Notice of Lis Pendens. Both the Complaint to Enforce Mechanic’s Lien and the Notice of Lis Pendens must be filed within 40 days of the date of recording the Notice of Intention.
